    Sure, I acknowledged their right to not do business with whomever they choose in my original post. My question is, is it right for them to refuse on these grounds? I find it ethically dubious.

    I probably wouldn't. But if I had to I would point out to them that the burden of proof is on them since they are making the assertion. Their is literally no proof to support their statement.
